How Are Workers’ Compensation Benefits Paid in Missouri?

At The Gogel Law Firm, our St. Louis workers’ compensation attorney understands how difficult it is to bounce back from a work injury without the benefits you are entitled to from your employer’s insurance coverage.

Missouri workers’ compensation benefits are designed to pay medical costs, lost wages, and temporary partial or total disability benefits, permanent partial or total disability benefits for injured workers throughout the state.

According to the Department of Labor and Industrial Relations, all Missouri employers with five or more employees are required to carry workers’ compensation insurance, regardless of whether the employees are part-time/casual laborers, full-time, or family members.

If you have been injured at work, it is important to understand which workers’ compensation benefits are available to you, and how they are paid.

Here is what you need to know.

What is Temporary Partial Disability?

Temporary Partial Disability is paid to injured employees weekly while they undergo the rehabilitative process and is available for up to 100 weeks.

The compensation is two-thirds of the difference between the injured employee’s earnings at the time the accident occurred and the income they can make while recovering.

For example, if an employee must take a lesser paying job while healing, temporary partial disability will help cover the difference.

What is Temporary Total Disability?

Temporary Total Disability is also paid to injured workers weekly during the rehabilitative process and is available for up to 400 weeks.

The compensation is two-thirds of the injured person’s gross average weekly wage, not to exceed a maximum amount set by the law.

What is Permanent Partial Disability?

When a work-related injury results in permanent disability, Permanent Partial Disability is paid in addition to Temporary Partial Disability or Temporary Total Disability benefits.

Permanent Partial Disability is paid when a worker suffers a life-long injury but can still work.

The compensation is two-thirds of the injured person’s average weekly earnings as of the date of the injury, not to exceed a maximum amount set by the law.

Some individuals may be eligible to receive a lump-sum payment based on the nature and extent of the disability.

What is Permanent Total Disability?

Permanent Total Disability applies when a worker is totally and permanently disabled.

The injured worker may be eligible to receive weekly payments over their lifetime or may negotiate a lump-sum settlement.

The compensation is two-thirds of the injured person’s average weekly earnings as of the date of the injury, not to exceed a maximum amount set by the law.
